These terms govern Fiftis and its optional Premium subscription for consumers and businesses. Statutory consumer rights apply to people acting primarily for private purposes. A paid contract requires the necessary legal capacity or valid representation.

The service is intended for international use. These terms do not restrict mandatory rights in the consumer’s country of habitual residence. Availability of paid subscriptions in individual countries is specified during ordering.

2. Service and limits of polling

Fiftis lets users create and share polls. Participants distribute a total of 100 percentage points among the options. Participation in online polls is free and does not require an account. Results represent submitted preferences and do not replace a binding professional decision.

The application is not a system for legally binding elections or verified one-person-one-vote participation. Clearing browser data or using another device may permit additional votes. Anyone receiving a poll link can access it within its publication settings; the link is not confidential participant authentication.

3. Free access, Premium and offline use

Free online polls have two options and remain available for 24 hours from creation, including their results. Creating an online poll requires an account.

Premium includes up to ten options per new online poll, availability of those Premium polls during paid access, closing and reopening voting, CSV results export, duplication as a new round and an email with results when voting closes. A new round does not copy existing votes. A later upgrade does not automatically extend polls previously created for free.

Offline rounds run locally on one device without a subscription. Initial offline preparation requires an internet connection and a supported browser. Local rounds are not uploaded to the server. Clearing browser data may permanently remove them.

4. Account and security

Sign-in uses a one-time email code or login link. Use an accessible email address you are authorised to access and protect your mailbox and login links. Report suspected misuse promptly. Liability for third-party actions is governed by applicable law.

5. Ordering and contract formation

The pricing display is an invitation to order. Before ordering, you may check and correct your account, selected plan and details or abandon the process. The contract is formed by the paid order on the final Stripe checkout page and acceptance through activation following confirmed payment. Redirecting to Stripe or returning to the app alone does not activate Premium.

The contract language is German or English, as selected when ordering. A confirmation including the applicable terms, consumer information and withdrawal notice with model form will be provided by email on a durable medium. A link to changeable web pages alone does not suffice.

6. Price and payment

The intended total price is EUR 2.00 per billing month. Any applicable taxes are included in that total. Fiftis charges no additional setup or transaction fees. Any foreign exchange or bank charges from your payment provider depend on your agreement with them. Tax implementation for supported countries must be settled before sales begin.

Payment is collected monthly in advance through Stripe using the payment methods offered on the final checkout page. A billing month begins on activation and need not be a calendar month. Ordering creates a recurring payment obligation. Publishing new prices alone does not change the price of an existing contract.

7. Term and cancellation

The subscription runs indefinitely and renews for one billing month at a time. You may cancel at any time without an additional notice period, effective at the end of the current paid billing period. Cancellation must be received before that period ends. The specific end date is shown in your account. The right to terminate for good cause remains unaffected.

You may cancel through subscription management in your profile or by an unambiguous statement to the provider, including email. Email cancellation does not require signing in. Merely closing your browser or removing the app does not cancel the subscription. Account deletion is not required to cancel. The direct online cancellation form is available without signing in through “Cancel subscription” in the footer.

Paid access continues until the regular period ends. Ordinary cancellation does not result in a proportional refund for the current month. Statutory rights, particularly withdrawal, remedies for defects or early termination, remain unaffected.

8. End of access and saving results

After paid access ends, older Premium polls are no longer available publicly or in your account. Polls less than 24 hours old may remain accessible only until the original free 24-hour deadline. A new subscription does not restore expired or removed polls. Export any results you need before access expires. Statutory rights to retrieve or access data remain unaffected.

Removing a poll from display is not the same as immediate complete erasure. Storage, retention and data subject rights are explained separately in the privacy information. These terms do not constitute consent to data processing.

9. Withdrawal and early performance

Consumers generally have a 14-day right of withdrawal from contract formation. Premium is an ongoing digital service; activation or initial use alone does not end that right.

Starting before the withdrawal period ends requires your express request. If you then withdraw in time, a proportional charge is payable only if the statutory conditions, including proper information and your express request, are satisfied. The withdrawal notice explains the calculation.

10. Content, rights and permitted use

You retain your rights to your content. You grant the provider only the rights necessary to store, display, transmit and technically safeguard it as required to provide the service, for the necessary duration. These terms do not authorise using your content for advertising or AI training.

Only submit content you are authorised to use. Illegal content, infringement of others’ rights, harassment, spam, malware, unauthorised access and deliberate manipulation of other users’ polls are prohibited. Do not publish sensitive personal information such as health data in polls. The application is not designed as an employee, patient or pupil records system.

You may report illegal content to the provider with the specific poll link and an explanation. Necessary anti-abuse measures will be proportionate. Where legally permitted, affected users will be informed about material restrictions or removals and their reasons and may contact the provider. Mandatory procedural rights remain unaffected.

11. Statutory remedies, updates and liability

Statutory rights concerning defects apply, including those for digital services. An ongoing service must conform to the contract throughout the agreed supply period. Necessary functional and security updates will be provided during that period. Statutory rights to conformity, price reduction or termination remain unaffected.

Liability for damages is governed by law. These terms contain no blanket exclusion of liability. Necessary technical maintenance does not exclude statutory rights. No additional guarantee of a particular uninterrupted availability is given.

12. Changes and applicable law

New terms or material detrimental changes to existing contracts do not become binding merely by publication. Contract changes are subject to statutory requirements; silence is not generally treated as acceptance.

Austrian law applies. Consumers retain the protection of applicable mandatory provisions in their country of habitual residence. Statutory rules on jurisdiction apply; no exclusive Vienna jurisdiction is agreed. Mandatory rights remain unaffected if any individual clause is invalid.
